Terms of Use

These Terms govern the use of Getsimplan ("the service" or "the platform"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the platform.

1.Who we are

Getsimplan is operated by AM Inteligência e Planejamento Ltda., registered under CNPJ No. 66.242.586/0001-09, headquartered in Curitiba/PR, Brazil. Contact: support@getsimplan.com.

2.What the service does

Getsimplan lets you upload a construction schedule (MS Project — .mpp/.xer/.xml and equivalent formats) and receive analysis dashboards: S-Curve, baseline vs actual Gantt, Critical Path and DCMA diagnostics, which you can save to your account.

3.Nature of the results — please read

The calculations and diagnostics are generated from the data you provide in your schedule. The platform is a support tool for analyzing and communicating physical progress, and it does not replace the technical judgment of the responsible professional, the project supervision/inspection, or the contractual verification of the works. You are responsible for reviewing and validating the results before using them in decisions, measurements or presentations. The figures reflect the quality and consistency of the input data.

4.Account and responsibilities

• You must be 18 or older and provide accurate information when registering;
• You are responsible for keeping your credentials confidential and for all activity on your account;
• You represent that you have the right to process the schedules and data you upload.

5.Acceptable use

You agree not to:

• Upload unlawful content or content you are not authorized to use;
• Attempt to access restricted areas, bypass authentication or overload the infrastructure;
• Copy, decompile or attempt to reproduce the calculation method, the software or the platform's engineering;
• Use the platform for fraudulent purposes or in ways that infringe third-party rights.

6.Intellectual property

The platform, the Getsimplan brand, the software, the physical-progress calculation methodology and the dashboard templates are owned by us and protected by law. These Terms do not transfer any of those rights to you.

Your data and the generated dashboards are yours. You grant us only the limited license necessary to process your schedule and display/store the dashboard in your account, as described in our Privacy Policy.

7.Privacy and data

The processing of personal data follows our Privacy Policy. In short: the uploaded file is processed and discarded immediately after the dashboard is generated (we do not store it); only the dashboard you save stays in your account, isolated and encrypted.

8.Plans, payment and support

• During validation, any voluntary contributions are appreciated (support for development) and do not, by themselves, constitute a service contract or a guarantee of features;
• When paid plans become available, prices, what each plan includes and billing terms will be clearly communicated before purchase;
• Right of withdrawal: for purchases made online, you may cancel within 7 days of contracting, under article 49 of the Brazilian Consumer Protection Code (CDC).

9.Availability

We aim to keep the service available and stable, but it may undergo maintenance, updates or temporary unavailability. As it is in validation, it is provided "as is", without a guarantee of uninterrupted availability.

10.Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for decisions made based on the dashboards, for indirect losses, lost profits, or for inaccuracies arising from incorrect input data. Nothing in these Terms removes any rights you may have as a consumer.

11.Suspension and termination

You may close your account at any time. We may suspend or terminate access in case of a breach of these Terms or use that puts the platform or third parties at risk.

12.Changes to these Terms

We may update these Terms. The current version will always be on this page, with the date at the top. Continued use after material changes means you accept the new version.

13.Governing law and jurisdiction

These Terms are governed by Brazilian law. The courts of the District of Curitiba/PR are elected to settle any disputes, except where a rule of jurisdiction benefits the consumer.
